Information notice: Processing of personal data for recruitment purposes.

This Privacy Policy explains our approach to any personal data that we collect about you when you use the www.rinf.tech (the “Website”). The purpose of this document is to inform you about collection, storage, use and disclosure of your personal data (“Personal Data”) as a result of using this Website and your rights in this regard. Please read this policy carefully before providing us with any Personal Data.

Ensuring the right to personal data protection is a fundamental commitment of RINF TECH and therefore we devote all our resources and make every effort to process your data in full compliance with Regulation (EU) 2016/679 (“GDPR”), as well as with the relevant legislation applicable in Romania. One of the key principles of this legal framework is transparency and we want you to be fully informed, so we have prepared this document to show you how we collect, use, transfer and protect your personal data when you interact with us through our Website.

We reserve the right to periodically update and modify this Privacy Policy so that you always have access to and are aware of any changes to the way we process your personal data, as well as any other changes to the legal requirements. In the event of any such change, we will display on our Website the updated version of our Privacy Policy, and therefore it is advisable to periodically check the contents of this Privacy Policy.

The data controller is RINF OUTSOURCING SOLUTIONS SRL, a Romanian legal entity, with its registered office in Green Court Bucharest, 4 Gara Herastrau Street, Building B, 3rd Floor, District 2, with registration number with the Trade Register J40/1436/01.02.2006, unique tax registration number RO18334380 (hereinafter referred to as “RINF TECH” or “us“).

III. How we obtain your Personal Data

  • Generally, we collect personal data that comes directly from you and thus you control and decide which pieces of information you are willing to share. For example, when you send us a message using the contact form or when you apply for a job at RINF TECH using the Careers section of the Website.
  • According to our Cookie Policy, information on cookies or other similar technologies can be stored and collected on our Website.

 

Please note that this Website is not intended for the collection of Personal Data relating to persons who are underage.

For instance, in drafting the relevant agreement, we may have to rely on your Personal Data of relevance for your case.

3. If you are a job/internship applicant

If you apply for an open position in our company, we will process Personal Data necessary for the recruitment process. You can find out more details in the dedicated Recruitment privacy notice.

4. If you are a visitor of our premises

Visiting our office spaces is subject to the security measures implemented by the office building owner (an entity which is separate from us). Any personal data processing necessary for such security purposes (such as visitor registration or CCTV monitoring) is processed by the building owner, acting as an independent controller, and is subject to the building owner’s data processing policies.

V. Duration of the processing

We intend to keep your Personal Data for the duration necessary for reaching the purposes for which we collected the information and according to our internal policies and specific legislation (for example, accounting and tax legislation). Personal Data collected in connection to the provision or RINF TECH services will be kept for the duration of the provisions of such services, and an additional statutory period which enables us to protect our rights and interests in relation to third parties. E-mail messages are kept according to our e-mail archiving policy. Other applicable data retention periods are provided in specific privacy notices, such as the Recruitment Privacy Notice or the Cookie Policy.

VI. Recipients of your personal data

As the case may be, we may transmit or provide access to certain personal data to the following categories of recipients:

  • companies within the same group of companies as RINF TECH, for internal administrative purposes and for the provisions of requested services;
  • providers of information technology and support system, including email archiving, disaster recovery and cybersecurity and recovery services;
  • organizations which provide us relevant services for maintaining and developing this Website and its tools;
  • other entities, such as public authorities and institutions, accountants, auditors, lawyers and other external professional consultants, when their activity requires knowledge of the data or when the law requires us to disclose them.

We will also disclose Personal Data to third parties in the following cases: if you request or authorize us to do so; to persons demonstrating legal authority to act on your behalf; where it is in our legitimate interest to do so in order to run, grow and develop our business: (i) in case of a transfer of undertaking (we sell a part of the business or certain assets) related to the job you apply for, we may disclose your personal information to the prospective buyer of such business or assets, in order to ensure that the activity continues as a going concern, or (ii) if RINF TECH (or a substantially part of its assets) are acquired by a third party, in which case personal information held by us will be one of the transferred assets; if we are under a duty to disclose your personal information in order to comply with any legal obligation or any lawful request from public authorities; to respond to any claims, to protect our rights or the rights of a third party, to protect the safety of any person or to prevent any illegal activity; to protect the rights, property or safety of RINF TECH, its employees, customers, suppliers or other persons. We do ensure that access to your data by third-party private law entities is done in accordance with the legal provisions on data protection and confidentiality of information, based on contracts concluded with them.

VII. Transfer of personal data abroad

In this regard, we will always take the necessary measures to ensure that any international transfer of personal data is carefully managed so that your rights and interests are always protected. The transfers to service providers and other third parties will always be protected by contractual commitments and, where appropriate, by other safeguards, such as standard contractual clauses issued by the European Commission.

VIII. Security of the data processing

We are committed to ensuring the security of personal data by implementing appropriate technical and organizational measures, according to the industry standards.

We keep your personal data on secure servers using state-of-the-art encryption algorithms and ensuring storage redundancy.

Despite the measures taken to protect your personal data, we mention that sending information on the Internet in general as well as through other public networks is not entirely secure, with the risk that data may be seen and used by unauthorized third parties. We cannot be responsible for such vulnerabilities of systems that are under our control.

IX. The data subject’s rights in respect of the data processing

Within the context of the processing of your personal data, you have the following rights:

  1. The right of access to the processed personal data: you have the right to obtain a confirmation whether or not your personal data are being processed, and, if affirmative, to have access to the type of personal data and to the conditions of processing, by addressing a request in this respect to the data controller indicated in Contact Details section below;
  2. The right to request the rectification or erasure of personal data: you have the possibility to request, by sending a request in this respect to the data controller indicated in Contact Details section below, the rectification of inaccurate personal data, the supplementation of incomplete data or the erasure of your personal data in case (i) the data are no longer needed for their original purpose (and no new lawful purpose exists), (ii) the lawful basis for the processing is the data subject’s consent, the data subject withdraws that consent, and no other lawful ground exists, (iii) the data subject exercises the right to object and the controller has no overriding grounds for continuing the processing, (iv) the data have been processed unlawfully, (v) erasure is necessary for compliance with EU law or Romanian law, or (vi) the data were collected in connection with the informational society services offered to children (if the case), where specific requirements regarding consent are applicable;
  3. The right to request the restriction of processing: you have the right to obtain the restriction of processing in cases where: (i) you consider that the processed personal data are inaccurate, for a period enabling the controller to verify the accuracy of the personal data; (ii) the processing is unlawful, however you don’t want us to erase your personal data, but to restrict the use of data; (iii) in case the data controller no longer needs your personal data for the above-mentioned purposes, but you are requiring the data for establishing, exercising or defending a legal claim or (iv) you have objected to processing pending the verification whether the legitimate grounds of the data controller override those of the data subject;
  4. The right to withdraw your consent for processing, when the processing is based on consent, without affecting the lawfulness of processing undertaken until that moment;
  5. The right to object to the data processing on grounds relating to your particular situation, when the processing is based on legitimate interest and to object at any moment to the data processing for direct marketing purposes, including profiling;
  6. The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly affects the data subject in a significant manner;
  7. The right to data portability, meaning the right to receive your personal data, which you provided to the data controller in a structured, commonly used and machine-readable format and the right to transfer those data to another controller, if the processing is based on your consent or the performance of a contract and is undertaken by using automatic means;
  8. The right to file a complaint with the Romanian Data Protection Authority (ANSPDCP) and the right to address to the competent courts of law.
